NJ Bankruptcy Judge Overturns J&J Tort Committee Split

By Rick Archer (January 19, 2022, 3:42 PM EST) – A Iowa bankruptcy judge on Wednesday reversed the split of the U.S. Trustee’s Office of the Tort Committee in the Johnson Talc Fallout Chapter 11 case & Johnson, saying the office had no right to overturn the North Carolina court order forming the original committee.

In a summary ruling from the bench, U.S. Bankruptcy Judge Michael Kaplan dismissed the office’s arguments that it had the authority to create two new committees from the original and that it had no authority to review its decisions, saying it would exercise that power with an order restoring the original single committee.
